Hereby is covered a Range of Commodities/Items that requires authorization/Certification from Specific Saudi Government Ministries to be Imported into the Kingdom else requires a Certificate of Conformity from the shipper
COLLECT OF SHIPMENT
Where SAB EXPRESS has agreed to bill the consignee for the cost of the shipment SAB EXPRESS reserves the right to refuse delivery until all transportation and other charges have been paid. If consignee refuses to pay, the shipper will be liable for all such charges, including without limitation, costs of returning the shipment if required.
THE SAB EXPRESS WAYBILL
Upon shipment collection, SAB EXPRESS issue an AWB subjects to the following: A. This SAB EXPRESS waybill in NON-NEGOTIABLE and the shipper acknowledges that it has been prepared by the shipper or by SAB EXPRESS on behalf of the shipper. The shipper warrants that it is the owner of the goods transported hereunder, or it is the authorized agent of the owner of the goods, and that it hereby accepts SAB EXPRESS terms and conditions for itself and as agent for and on behalf of any person having any interest in the shipment.
B. The shipper shall be solely liable for all cost and expenses related to the shipment and for costs incurred in either returning the shipment to the shipper or warehousing the shipment-pending disposition. The shipper acknowledges that SAB EXPRESS is not a common carrier and that SAB EXPRESS reserve the right to refuse or abandon the carriage or transportation of any goods for any person, firm or company and the carriage of transportation of any class of goods at its discretion.
RIGHT OF INSPECTION OF SHIPMENT
SAB EXPRESS has the right, but not the obligation, to inspect any shipment, including, without limitation, opening the shipment. In relation to each shipment SAB EXPRESS reserves the right to correct any under-declaration or weight and re-invoice the customer accordingly.
LIEN IN GOODS SHIPPED
SAB EXPRESS shall have a lien in any goods shipped for all transportation charges, advances or other charges of any kind arising out of transportation hereunder and may refuse to surrender possession of the goods until such charges are paid
Delivery OF SHIPMENT
SAB EXPRESS shall deliver all consignments to the address of the consignee, registered in the service contract, and shall be responsible for any loss, delay or miss delivery caused by it.
The consignment shall be delivered to the named consignee or so authorized representative with applying restricted procedures to verify the identity of the recipient before handover.
SAB EXPRESS shall recollect any consignment with miss-delivered.
Failure of delivery of a consignment due to the consignee’s refusal to receive them or for any other reason by the beneficiary, SAB EXPRESS shall apply the rules and procedures for dealing with the non-deliverable items declared in his platforms and service centers, provided that such rules shall take into account the number of attempts to be made for the receipt. , And these rules and procedures comply with international rules in this regard
SAB EXPRESS shall record and keep the procedures for dealing with postal materials that could not be delivered in a documented special register established for this purpose, for a period not less than one calendar year from the date of the action taken.
RETURN OF SHIPMENT & AMEND ADDRESS
The shipper may request the return of consignment or amend the address of the consignee, before delivery to the consignee. In addition, the beneficiary may be charged any additional fees as applicable
Undeliverable Procedure:
UNDELIVERABLE of a shipment can be either at the instructions of the customer or get agreement from both parties if the shipment is held beyond a reasonable period or delivery attempts. UNDELIVERABLE of shipment can be due to following reasons, but not limited to.
The shipper has requested for UNDELIVERABLE.
The consignee refuses to accept the shipment.
The consignee refuses to pay charges applied to the shipment against duties, taxes, freight on delivery, cash on delivery, labor charges, additional handling charges, etc.
The consignee has moved from the address shown on the waybill or the address in incomplete/incorrect and the shipper cannot assist in obtaining the correct delivery address.
The consignee refuses to provide documentation required by the destination customs authorities, to facilitate the clearance of shipment.
UNDELIVERABLE charges are applicable, as agreed on the rate matrix.
If the shipments are to be re-directed to a new address, then the shipper does not agree to pay the redirection charges. SAB EXPRESS reserve the right to request the consignee to pay these charges in cases where redirections required to cities different to the initial destination city
Returned shipments:
Returned shipment terms are subject to agreements and provisions between the shipper and the recipient and SAB EXPRESS do not represent any party to these terms. Where SAB EXPRESS adheres to the shipping procedures only.
LIMITATIONS OF LIABILITY
Without prejudice to Clause 9, the Liability of SAB EXPRESS for any loss or damage to the shipment is limited to the lesser of: 100 SR The amount of loss or damage to parcel actually sustained, or The actual value of the parcel as determined under section 6 hereof, without regard to its commercial utility or special value to the shipper. In case of previous contract concluded with the shipper, irrespective the expiry of its duration, then such contract will be considered a reference for both parties, and the signature of the shipper on this waybill will give effect to that contract.
ACTUAL VALUE
The actual value of a parcel (which term shall include any item of commercial value which is transported hereunder) shall be ascertained by reference to its cost of repair or replacement, resale or fair market value at the time and place of shipment, whichever is the less. In no event shall such value exceed the original cost of the article paid by the shipper plus 10%.
CONSEQUENTIAL DAMAGES EXCLUDED
SAB EXPRESS shall not be liable, in any event for any consequential or special damages or other indirect loss, whether or not SAB EXPRESS had acknowledge that such damages might be incurred, including but not limited to, loss of income, profits, interest, utility or loss of market or any penalties.
LIABILITIES NOT ASSUMED
While SAB EXPRESS will endeavor to exercise its best efforts to provide expeditious delivery in accordance with regular delivery schedules, SAB EXPRESS will not, under any circumstances, be liable for delay in pick up, transportation or delivery of any shipment, regardless of the cause of such delay. Further, SAB EXPRESS Express shall not be liable for any loss, damage, mis-delivery on non-delivery:
(a). due to Act of God, force major occurrence or any cause reasonable beyond the control of SAB EXPRESS or,
(b). Caused by:
(i) The act, default or omission: of the shipper, the Consignee or any other party who claims an interest in the shipment (including violation of any term or condition hereof) or of any person other than SAB EXPRESS or of any other Government official. Alternatively, of any Postal Service, forwarder to other entity or person to whom shipment is tendered by SAB EXPRESS transportation to any location not regularly served by SAB EXPRESS regardless of whether the shipment requested or had knowledge of such third-party delivery arrangement. (ii) The nature of the shipment or other defect, characteristic, or inherent vice thereof, (iii) Electrical or magnetic injury, ensure, or other such damage to electronic or photographic images or recordings in any form.
CLAIMS
SAB EXPRESS’S claim rules & procedures shall be enforced.
APPLICABILITY
These terms and conditions shall apply to, and injure to the benefit of SAB EXPRESS and its authorized agents and affiliated companies, and heir office, directors and employees.
INSURANCE
At the request of the shipper and upon payment thereof, SAB EXPRESS will arrange insurance on behalf of the shipper.
a. The insurance coverage shall be governed by all of the terms and conditions contained in the policy of insurance issued by the insurance carrier.
b. SAB EXPRESS is firstly not to be liable at all for certain Losses and Damage. Secondly, wherever they are to be liable, the amount of the liability is strictly limited to the amount stated in the condition 7. Customers are therefore advised to purchase insurance cover to ensure that their interests are fully protected in all events.
c. the shipper agrees to the terms and conditions stated herein. No agent or employee of SAB EXPRESS or the shipper may alter or modify these terms and conditions.
d. Consequential Damages and Loss or Damage Resulting from delays in transportation is not covered by any such policy of insurance.
Beneficiary Rights & Obligations
- The beneficiary shall read and accept the terms and conditions of service, contract, payment mechanism and redemption before approving the execution of the application.
2. The beneficiary shall pay the service provider as agreed in the service contract.
3. The beneficiary is responsible for the correctness of the information and data entered by the beneficiary.
4. The shipper warrants that each article in the shipment properly described in this Air waybill has not been declared by SAB EXPRESS to be unacceptable for transport and that the shipment is properly marked and addressed and packaged to ensure safe transportation with ordinary care in handling.
5. The shipper warrants that all laws and regulations of Saudi Arabia, to, from, though, or over which the shipment may pass, have been complied with.
6. The shipper certifies that all information provided to SAB EXPRESS or set forth in this SAB EXPRESS waybill is accurate and complete.
7. The shipper agrees to indemnify and hold SAB EXPRESS harmless for any claim, liability or expense arising from the shipper’s failure to comply with any applicable law or regulations.
8. The Beneficiary has the right to the services against the declared prices without any increase.
9. The beneficiary shall verify the consignment before signing delivery note.
10. Any beneficiary to whom consignment has not been delivered or found shall notify the service provider through one of the approved channels of communication.
11. SAB EXPRESS have the right to change, modify, cancel and add the terms and conditions relating to SAB EXPRESS service mentioned here in without notice.
12. SAB EXPRESS comply with the terms and conditions in force at the date of signing the service contract.
